Welcome to List49 (“List49,” “we,” “us“). These Terms of Use (“Terms“) govern your access to and use of the List49 website, mobile experience, and related services (together, the “Platform“). By creating an account, posting a listing, or otherwise using the Platform, you agree to these Terms. If you don’t agree, please don’t use List49.
1. What List49 Is — and Isn’t
List49 is an online classifieds marketplace that connects people across Canada looking to buy, sell, hire, get hired, or find services. We are a listing platform, not a party to any transaction. We don’t buy, sell, own, inspect, or guarantee any item, job, service, or property listed on the Platform. When you deal with another user, you’re dealing directly with them — not with List49.
2. No Guarantee, No Liability for User Conduct
Like any classifieds platform, List49 cannot verify the identity, intentions, or honesty of every person who uses the site. We work to control quality through account verification badges, moderation, reporting tools, and review systems — but we cannot and do not guarantee that any one specific listing, message, or user is safe, accurate, or legitimate.
To the fullest extent permitted by law, List49 disclaims all liability for:
- The accuracy, quality, safety, or legality of anything posted by users
- Any interaction, transaction, meeting, or dispute between users
- Any loss, damage, injury, or fraud arising from your use of the Platform or your dealings with another user
You use List49, and you deal with other users, at your own risk. We strongly encourage reviewing our Online Safety guide before buying, selling, or meeting anyone through the Platform.
3. Your Responsibility for What You Post
You are solely responsible for any content you post — listings, messages, photos, reviews, and profile information. By posting, you confirm that:
- You have the right to sell, offer, or advertise whatever you’re listing
- Your listing is accurate and not misleading
- Your content doesn’t violate any law, infringe anyone’s rights, or violate our Posting Policy
We may remove any content, suspend, or terminate any account, at our discretion, without prior notice, if we believe it violates these Terms, our policies, or applicable law.
4. Accounts
You must be at least 18 years old (or the age of majority in your province) to create an account. You’re responsible for keeping your login credentials secure and for all activity under your account.
5. Fees and Subscriptions
Some features of List49 (posting limits, listing add-ons, membership plans) require payment, processed securely through our payment provider, Stripe. Prices, plan details, and refund handling are described at checkout and on our Membership page. We reserve the right to change pricing with reasonable notice.
6. Prohibited Conduct
You agree not to use List49 to:
- Post anything illegal, fraudulent, or prohibited under our Posting Policy
- Harass, threaten, or scam another user
- Attempt to circumvent our moderation, verification, or security systems
- Scrape, copy, or misuse data from the Platform
7. Limitation of Liability
To the maximum extent permitted under Canadian law, List49 and its owners are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability for any claim relating to the Platform is limited to the amount you paid us, if any, in the 12 months before the claim arose.
8. Governing Law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Manitoba.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of List49 after changes take effect means you accept the updated Terms.
